Commission Terms and conditions
I, Sue Gardner, of 6 Rushtons Yard, Market Street Ashby de la Zouch lE65 1AL will be hereafter called ‘the artist.
The Project The artist agrees to provide the customer with a handcrafted and bespoke oil painting on stretched canvas, gallery-wrapped ready to hang based on the customer’s requirements.
Payment Terms and Agreement Upon acceptance of the commission, the artist will send via email a statement of work detailing the proposal, together with an invoice for 50% non -refundable deposit. Payment of the deposit constitutes agreement with the statement of work. The customer will be sent final photographs for approval, upon which, once given, the balance invoice will be sent. The final invoice is payable within 14 days. Once full payment has been received the painting will be despatched.
Rights The painting, once full payment has been made, transfers into the customer’s ownership. Copyright and rights of reproduction remain with the artist. The customer may not create copies for sale under any circumstance. The artist will not create copies for sale without the express permission of the customer. The original painting may be exhibited, loaned or sold by the customer.
Statement of Work This document details the project and is sent via email with the first invoice. To include predominant colour scheme, size of the painting, subject matter, intended finish date, and payment details.
Termination Agreement The agreement may be terminated at any time by the customer. The initial deposit is non -refundable. If the agreement is terminated after approval when full payment has been made and before the painting has been despatched, the final payment and shipping are refundable. Once the painting has been approved and despatched, no refunds can be given.
The artist reserves the right to terminate the agreement at any time, in these circumstances all payments are refundable.
Scope of Project The artist will create a bespoke piece of work based on customer requirements, She will paint intuitively using her own unique style as seen in her body of work. She does not specialise in reproducing previous works, and will not undertake to reproduce the work of other artists. At the approval stage, the customer will have the opportunity to view the work via photos/video and request small changes if required. The quoted price includes up to two such alterations. Further alterations of changes to the scope of the original project will be charged at the usual rate. The customer will be sent final photographs for approval, upon which the balance invoice will be sent.
